You may post or upload content you have created, including without limitation, photographs, your social media handle, videos, and comments (collectively, “User Submissions”) to your social media accounts. By posting and uploading User Submissions that you have tagged with #watermarkdesigns, #thewatermarkcollection, #watermarkcollection, or other Watermark Designs branded hashtags, or by tagging @watermarkbrooklyn, @watermarkbklyn, or @watermarkdesigns, you grant to Watermark Designs and its subsidiaries, affiliates, and third-party service providers who provide content management services (collectively, the “Licensed Parties”) the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your Watermark-tagged User Submissions in any manner to be determined in Watermark's sole discretion. This grant includes, but is not limited to, use of the User Submissions on Watermark social media pages (including but not limited to Facebook, Instagram, Twitter and Pinterest) and on Watermark websites, and in other Watermark marketing, promotional and advertising initiatives, in any media now or hereafter known. Watermark may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Submissions in any manner in its sole discretion, with no obligation to you whatsoever.
You grant Watermark the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Submissions. You hereby represent and warrant that: (i) you are at least 18 years old; (ii) you are the owner of your User Submissions; (iii) the User Submissions do not infringe someone else's copyright, trademark, proprietary rights or rights of publicity and privacy; (iv) the User Submissions do not violate a law, statute, ordinance or regulation; and (v) if the User Submissions contain the likeness and/or name of an identifiable person, you have that person's permission to include their likeness and/or name in the User Submissions. You are solely responsible for your User Submissions, and Watermark assumes no liability for any User Submissions.
Watermark will not be liable for damages of any kind, including without limitation special or consequential damages, arising out of your access to, or inability to access, your User Submissions or your use of, or reliance upon, this language or the site(s) where your content is located. Further, Watermark is not responsible nor liable for your use of other web sites which may have access to your User Submissions. You further irrevocably waive any "moral rights" or other rights with respect to attribution of authorship or integrity of materials regarding User Submissions that you may have under any applicable law under any legal theory.
